Terms of service

1. Purpose
These Terms of Service ("Terms") govern access to and use of the MaxiSquare website and service, which allows users to browse a catalogue of furniture and decoration products, and to generate artificial-intelligence-assisted interior design proposals from a photo.

3. Access to the service and accounts
Certain features are accessible without an account, within the limits of restricted free use. Creating an account (email address and password) grants access to broader free use and additional features (profile, history). The user is responsible for keeping their credentials confidential.
4. Service operation and quotas
The generation of proposals and their adjustments is subject to free-use quotas, the details of which are communicated in the interface at the time of use. These quotas may change. Beyond these limits, a pay-per-use unlock mechanism is planned; its terms will be communicated before it goes live.
5. Content provided by the user
Photographs and information submitted by the user are used solely to generate the requested proposals, including via third-party artificial intelligence services engaged for this purpose. See the FAQ page for details of this processing.
6. Products and purchases
The products displayed come from third-party supplier catalogues. MaxiSquare is not the seller of the products displayed: any purchase is made directly on the relevant supplier's website, which is subject to its own terms of sale, prices and availability. MaxiSquare does not guarantee the real-time accuracy of the prices and availability displayed. Some links to supplier websites are affiliate links (Awin and Adtraction networks): when a purchase is made through one of these links, MaxiSquare may receive a commission from the supplier, with no effect on the price paid by the user. Displayed prices are indicative and dated; only the price shown on the supplier's website at the time of purchase applies.
7. Intellectual property
MaxiSquare's brand, logo and graphic elements are protected. Generated proposals may be used by the user for their own personal design project.

Subscribing to the newsletter is optional and may be cancelled at any time; see our personal data processing information below.
9. Personal data
The data controller is MaxiSquare (contact details in Section 2 above). The following data may be processed: email address and password (account), profile and style preferences, photographs submitted for a generation, the email address used to sign up to the newsletter, as well as standard technical browsing data.
This data is processed to provide the service (account creation, generation of proposals, application of usage quotas), to send the newsletter (based on the consent given at sign-up) and, where applicable, to improve the service. Depending on the case, processing is based on the performance of the contract between you and MaxiSquare, on your consent, or on MaxiSquare's legitimate interest in ensuring the proper functioning and security of the service.
Certain data (in particular photographs submitted) is shared with third-party artificial intelligence providers engaged to generate the proposals (see the FAQ page), which may be established outside Switzerland or the European Union; such transfers are governed by the contractual safeguards or compliance mechanisms put in place by these providers. Data is retained for as long as necessary for the purposes described above, and thereafter until the account is deleted or the user unsubscribes from the newsletter, subject to any retention periods required by law.
In accordance with the Swiss Federal Act on Data Protection (FADP) and, for users residing in the European Union, the General Data Protection Regulation (GDPR), you have the right to access, rectify, erase, restrict and object to the processing of your data, as well as, under the conditions set out in the GDPR, a right to data portability. These rights may be exercised by writing to contact@maxisquare.com. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) in Switzerland, or, for European Union residents, with the competent data protection authority in your country of residence.
10. Liability
Proposals generated by artificial intelligence are suggestions; it is the user's responsibility to verify their suitability for their actual space (dimensions, technical constraints) before making any purchase or carrying out any work.
11. Changes to these terms
MaxiSquare may amend these Terms; the version in force is the one published on this page at the time of consultation.
12. Governing law
These Terms are governed by Swiss law, excluding its conflict-of-law rules. For consumer users residing in the European Union, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.
